The New York State Department of Health investigates complaints against doctors and hospitals. When you make a complaint, the Department of Health may investigate by reviewing the medical records and interviewing doctors and nurses. The investigation usually takes between 3-4 months. After the investigation has been completed, the Department of Health may issue a document called a "Statement of Deficiencies�?. The Statement of Deficiencies lists the specific deficiencies in medical treatment by the doctor or hospital and the hospital must respond with a document called a "Plan of Corrections�?. The Plan of Corrections shows the hospital's plan to avoid the same medical mistakes from happening again. How to Get the Statement of Deficiencies and Plan of Corrections You can get the Statement of Deficiencies and the Plan of Corrections by sending a request by mail to the Department of Health. While the names of the patient will be crossed out to preserve patient confidentiality, the Statement of Deficiencies and Plan of Corrections will give you great information about the specific findings of medical negligence. How Department of Health Findings Can Help Your Case The factual findings by the Department of Health are admissible in evidence at the trial of your medical malpractice lawsuit. If they are able to show that the treatment you received in the past is somehow connected to either the complaints that you made or similar treatment, then in all likelihood the judge will allow them to get more of your past medical records. Why would they do this? In order to scour the records to look for contradictions. NISKAYUNA -- On top of any confusion about the Affordable Care Act, as the October 1st start date for some parts of it inches closer, the number of complaints coming in about scammers trying to take advantage of it is creeping higher. A follow-up to a Bottom Line Alert that CBS 6's Dori Marlin has been tracking for weeks now. The Federal Trade Commission had already warned of related scams cropping up - and now the Better Business Bureau tells Dori, they've received dozens of complaints from people in Upstate New York. The agency is also more specifically spelling out how these scams are working. First, there's this one: The caller reportedly claims to be a Medicare employee - then demands money in order for you to proceed, and be eligible for healthcare coverage. And, there's this one: Consumers being directed to websites or call centers, to sign up for what they're told is discount health insurance. Dori asked the BBB, Have you heard from anyone who unfortunately has fallen for one of these scams already? We've gotten alot of these calls after the fact, and that's where the problem is, says BBB spokesperson, Peggy Penders. Yes, several people have given away personal information to people that they do not know, and that's where the trouble is. Officials warn that if you get one of the calls, just hang up. Don't call back, and don't press any buttons that the caller tells you to. Also, don't rely on Caller ID since what shows up there might not be accurate. And finally, as always, don't give out your personal information to someone you don't know.

What do you think he said? Of course he said “No.” However, here is what I did first and then ultimately asked in a series of questions about whether he believed he violated good medical practices. WHAT ARE THE STANDARDS OF MEDICAL CARE? I asked him specifically what were the standards of care when treating a patient with this particular condition. “Doctor, in a patient who comes in with the following complaints, would you agree it is good medical practice to obtain a medical history? Would you agree it's good medical practice to obtain a thorough history? Would you agree that it is appropriate for a doctor to obtain a detailed history from the patient? In a patient who presents with the following symptoms, would you agree that you must formulate in your own mind or on paper a differential diagnosis? You know that a differential diagnosis is a list of the most likely diagnoses in order of most likely to the least likely. Correct? And for each of those diagnoses, there are various diagnostic and clinical tests that must be performed in order to rule in or rule out each of those conditions. Correct? If your initial working impression is that the patient had this particular condition, would you agree it would be appropriate to obtain either x-rays or CAT scans or MRIs? Would you also agree that it would be good medical practice for the doctor to perform a physical examination of the patient? When performing a physical examination, would you agree it's important to do the following things... Once you have ruled out a particular condition on your list of possible medical conditions, would you agree that you then need to go to the next likely condition and then perform various diagnostic and clinical tests to again rule in or rule out that condition. If a physician does not consider the following condition for these presenting symptoms, would you agree that would be a departure from good and accepted medical practice? If you did not consider XY and Z. as part of your differential diagnosis, would you agree that that would be a violation from the basic standard of medical care? WHAT'S THE STRATEGY? Keep in mind that there is a clear strategy of asking questions this way. In a medical malpractice case in New York, I need to establish from the doctor who we have sued exactly what the standards of care were for the patient at that particular time. The way to lock the witness into his testimony is to use his own words to establish what the standards of care were, and at a later time I will have an opportunity to ask him whether his own care and treatment were within his own definitions of what the standard of care was. Naturally, if you ask any doctor straight out whether or not they violated good basic medical practices, they will always become defensive and say no. However, if you set it up correctly, you can then ask the doctor hypothetical questions using our version of the events that occurred in which the doctor has to agree that if certain things were not done, based upon his own statement of what the standards are, then it would be a clear violation from good medical practice. When somebody else broke the rules, I seek to go ahead and hold that person accountable. Often when somebody is involved in a New York auto accident, they're in a state of shock, a state of disbelief and they're not certain what to do, so let me share with you a few things that you should do to protect yourself and your family. First, move the cars off the road. I can't tell you how many accidents I've seen where people leave the cars, get out, look at the damage in the middle of a freeway, and often stand between the vehicles such as they expose themselves to further injury. Looking at property damage while a vehicle is still on the travel portion of the highway is extremely dangerous. Next, call 911. Summon the police. Even if the other side says, or the person who hit you says, we don't need the police / we'll take care of it, call the police. You don't know if the person is insured, has no insurance or is just going to leave the scene. Next thing, take photographs. Use your cell camera and take pictures of the property damage, of the surroundings, of the vehicles, of any injuries you have. Next, get the information from the driver. The other driver is obligated to go ahead and give his name, license and insurance card. Get the insurance company and the serial number. Also, get the names of witnesses. Very often there are witnesses, bystanders and good Samaritans that come to your aid that are there to help you. You're not thinking clearly, so make sure to get witness statements, names and addresses, because what you need to do is preserve the evidence early on. When the police or ambulance arrive and you're feeling any pain, however minor, go in the ambulance to the emergency room. Very often, there's a latency period. A lot of injuries don't occur until much later on. In fact, the insurance company will argue that you must have not been seriously injured, even though later you might require surgery because you didn't go in the ambulance. So though it may be embarrassing, if you feel any discomfort or pain, get in the ambulance. Once you're in the hospital, don't exaggerate but go ahead and document, share every complaint or concern you have with the doctor. However minor. In the event you sustain a fracture, the doctor's going to be just looking at the broken arm. But if your knee hurts or your shoulder hurts or ankle hurts, let them know. Document it, because the defense of the insurance companies will later claim that you must have hurt yourself elsewhere, even if you complained a week later because the time you went to the hospital, you did not voice a complaint. So, you're going to get in the ambulance, you're going to go to the hospital, you give every complaint, however minor to the doctors. If you are involved in a New York auto accident, these are the things you should do. First, get the vehicles off the road. Two, call police. Three, take photographs. Four, exchange the contact information -- name, address, insurance company, make model of the vehicle and license plate number. If any witnesses are present, get their names, numbers and contact information. Police show up, do not give a statement. Do not admit fault. Next, go to the emergency room. Give all complaints, however minor. Lastly, follow up with the insurance company and most importantly, call me. I will help you through this difficult and stressful process. Client Forgets Facts While Testifying at his Medical Malpractice Trial in New York. It's something he remembered a years ago. It's something he knew. In fact, two years earlier when he was asked the same question by the defense attorney during pretrial questioning, he knew this answer exactly. Can I use his pretrial testimony to refresh his memory about a specific event that he is currently having difficulty remembering? The answer is yes, I can. How do we actually do this? Let me give you an example... Let's say it is a medical practice trial and my client is on the witness stand explaining what the doctor did during each of his visits. I now ask him to explain when his next visit to the doctor was. He's having difficulty remembering whether it was in December, January or February. In fact, he's having difficulty remembering exactly what he said to the doctor on that particular visit. He's struggling. He sincerely doesn't remember. Even though he reviewed his pretrial testimony in anticipation of coming in to testify today, he simply does not remember. Even though a witness or a litigant has given pretrial testimony, the transcript of that question and answer session is simply not admitted into evidence. The jury does not know what questions and what answers were given two years earlier when the defense attorney was in our office questioning my client about what happened. I can always pull out a copy of the medical records which will have been admitted into evidence to tell my witness what is recorded in the medical record. However, in many cases I would prefer to have my client explain, in his own words, exactly what happened and when. That does not mean that he needs to memorize exact dates and times in order to be successful. This is not a memory test. Instead, if the witness is unable to remember events that occurred years ago, I can now use different documents and even pretrial testimony to try and refresh his memory. So here is how we do it... “Mr. Jones, two years ago you were in my office with the defense attorney asking you questions and you giving answers, correct?” “Yes, I remember that. You called that a deposition.” “That's correct. Now, I'm going to read to you from the transcript of the questions that you were asked and some of the answers that you gave. Let's look at page 17, line 9... Question: When did you next see Dr. Gonzalez? Answer: I saw him December 15. Question: what complaints did you make to Dr. Gonzalez at that time? Answer: I told him I was having difficulty breathing. I told him I had difficulty going up the stairs. I told him I was coughing up blood. Mr. Jones, were you asked those questions and did you give those answers at that time?” “Yes I did.” “When you gave those answers to those questions, were they accurate at that time?” “Yes they were.” “Did those questions and those answers refresh your memory about when you last saw Dr. Jones in his office?” “Yes they do. I now remember that I did see him on December 15.” “Did those questions and those answers refresh your memory about what specific complaints you made him on that last visit?” “Yes they do. I told him I was having difficulty breathing. I told him I had difficulty going up the stairs. I also told him I was coughing up blood.” What happens after I refresh his memory? I can continue asking my client questions which simply gets him over this little hurdle about something that he did not remember while he was on the witness stand testifying. Ok so I was looking at this graph put on Uber’s website today and thought it looked too good to be true. How amazing that Uber drivers make more than any other type of driver. But I knew from my own experience as a rider that Uber didn’t cost that much. In fact, Uber is pretty cheap if you’re a passenger. Sooooo…. how can uber be so cheap, and yet the drivers make so much money??? Now Uber has cut pay to drivers in Detroit to 24cents a mile , but we’re going to stick to the 90c for now. Uber takes 20% of the total fare from the driver for older drivers. Newer drivers get 25% taken. So we’re down to 67.5c per mile. Then you have to deduct tax: In some LA County's, sales tax is as high as 10%, and Uber doesn’t withold taxes for you. The drives are responsible for keeping this money aside to pay the tax department in April. So with the 10% deducted, we’re down to (just over 60 cents) 60.75c Now we need to factor in depreciation of the car. A car is an asset like anything else, and will eventually wear out and you’ll have to buy a new one. Every mile you drive decreases the value of your car and brings you that much closer to needing a new one. This is a big problem if you drive for a living, you’re going to need to buy a new car every two or three years and the cost of a new car is significant. The IRS estimates vehicle cost to drive a vehicle for work at $0.54 a mile . Broken down into Fuel costs @ an average of 12c per mile Depreciation at $0.24c per mile. Repairs, tyres, & maintainence at 9c per mile Insurance, licence, registration, finance, fees - average out to around 9c per mile So with 54c depreciation, repairs, and fuel accounted for, we’re down to just over 6c per mile that actually goes into your hands of drivers. Given that Uber also asks its drivers to buy things like bottles of water, gum, and chargers for it’s passengers, we can say for certain that driving for Uber pays well below minimum wage or even worse, costing drivers money (as is seen directly in this actual fare uber charged one of it’s drivers). So given the math is so bad, why does anyone drive for Uber? Here’s an example of a post an Uber driver posted - he was $400 behind on the rent, and needed to make up some quick cash. In a way, uber is kind of like a loans scheme. Now for some people in desperate circumstances, what Uber’s offering might be an acceptable deal. But for most people, driving for Uber is a waste of time. I wish Uber would be more honest with people. By our calculations, the amount you’re making as an uber driver is nowhere near $19 per hour. If you drive 30 miles per hour at 6.75c per hour, you’re only making $2.00 per mile - by far the worst choice of any transportation job. This number is supported by Not Cool Uber, who have tracked hourly earnings to be around $2.89 and, after vehicle fees are taken into account, $0. Now – I’m not against car pooling. We all need transport, and I know I am a frequent user of Uber & Lyft. But I think that Uber is going about it in an unethical way, which makes me unethical for supporting them as a customer. Uber could easily fix this situation : by reducing their commission, by making rates more reasonable, by giving riders the option to Tip their drivers, or just by being transparent. But that would mean admitting that they’ve generated significant revenue from effectively exploiting their drivers. So the truth is, Uber benefits from maintaining this status quo. Uber is currently reported to be making $10 billion in revenue per year - and that money has to come from someone. Just don’t let that someone be you. The New York City Housing Authority provides affordable housing for nearly half a million New Yorkers. But with a no-heat crisis and other ongoing health and safety issues, can NYCHA turn it around before it is too late? This has been a rough winter for tens of thousands of rent-paying NYCHA residents who found themselves without heat and without help on some of the coldest days in decades. Residents told us it was nothing new, but it was also never this bad. From Throggs Neck to Far Rockaway, one end of the city to the other, resident council leaders told us they were running high on complaints and low on results—a pattern all too familiar from the lead paint scandal and safety issues like crime, lighting, and security cameras. Aging buildings, boilers breaking down, lack of staff, and lack of funding—despite NYCHA's $3 billion annual budget—are the reasons we kept getting. Another frustration was no real timetable for repairs. So we put it to NYCHA Chair Shola Olatoye in a rare interview on a recent Street Soldiers episode. Some elected officials want her to step down. They accuse NYCHA management of incompetence, covering up problems, and not caring about residents. Bronx Borough President Ruben Diaz Jr. and City Comptroller Scott Stringer called the situation an emergency. Public Advocate Letitia James called for new leadership at NYCHA that recognizes the priorities of the residents, particularly the most vulnerable and marginalized. Days after announcing a $13 million emergency fund, Mayor Bill de Blasio told Good Day New York that he is sticking by his NYCHA chair, period. So we took it to the people of NYCHA housing in a ground-breaking town hall in the Bronx. Voices were united as residents demanded permanent fixes to the problems. Residents and resident council leaders from more than a dozen public housing developments came out with local youth and concerned elected officials to talk about ways to solve the persistent problems facing NYCHA residents. Residents have complained about no heat or hot water, urgent repairs not being made, broken promises, and dangerous health issues like lead and mold exposure. Street Soldiers invited the mayor and NYCHA to attend or at the very least send representatives but they were all no-shows. Our panelists who grew up in public housing say it is time to take the issues to NYCHA and City Hall. Joining our panel was hip-hop artist Ja Rule. We had a lot of support for the town hall from Hot 97, which helped us get the word out and provide refreshments, to the hit web series "Project Heat," which is based in the Pink Houses, to our event host, the Bronxworks Community Organization, which empowers Bronx residents to live their best life possible. Insurance Drives Physical Therapists out of Business HIP/EMBLEM insurance announced major cuts in reimbursement for Physical Therapy while increased salaries and bonuses for its executives. The action may threaten private practice Physical Therapy in New York State. New York, NY (PRWEB) 22, April, 2009 HIP/EMBLEM insurance announced to its Physical Therapy participating providers a 20% reduction in reimbursement rates to be in effect May 1, 2009. Physical Therapists who do not agree with the reduction will be expelled from the provider panel. It appears that such a decrease in reimbursement serves to offset HIPs deficit for the new salaries to its officers: The New York Sun on 4/22/2008 reported that Anthony Watchon president of HIP doubled his salary to $4.79 million (FYI -- $4.79 million is enough to provide healthcare for twelve months to nearly 1,400 people at $3,500 each). The newspaper stated: This is just a foretaste of what will happen if the state allows it to convert to for-profit corporation. HIP has already been amongst the insurance companies with the lowest reimbursement rates to Physical Therapy and other medical services. If this reduction comes into effect it will trigger further reductions by many other insurance companies in New York State, leading to the extinction of private practice physical therapy. At the same time, this reduction in reimbursement to Physical Therapy services will lead to a significant compromise of the quality of service of patients. Simply said, physical therapists will have to see many more patients per hour to accommodate for this change in reimbursement which will lead to a substandard service. When HIP/GHI sought approval for the change to for profit status, they promised to the people of NY and especially their members that: Conversion to for-profit status will not affect service to our members, their access to doctors, their benefits, or the levels of service that they currently receive. Over time, as new products and services are introduced, members should see greater flexibility in types of coverage, more choice in benefit plans, and more customer-driven innovations that improve access to care. It is obvious that this promise has been broken because with such low reimbursement rates the level of service to the members will definitely be affected. Many physical therapists in New York are already dropping out HIPs panel, while others have filed complaints with the Attorney Generals Office and the State Insurance Commissioner.

Campaign has been organizing thousands of workers throughout New York State to stand up against sweatshop conditions in the service industry. In spite of firing, blacklisting and even physical assault from employers, many workers have still come forward to fight for their rights. This has not only improved working conditions, but also has helped many other workers gain confidence to enforce the law through litigation or filing complaints with government agencies. In 2009, due to the complaints of 20 drivers of the Flushing New York enterprise, Yes! Car Service, the NY State Department of Labor began investigating rampant misclassification practices in the car service industry. For over ten years, drivers worked up to 16 hours per day without any wages and were forced to pay the company weekly fees to work. Owner Tony Luo collected all cash from the drivers and did not report to the government. When drivers protested the fees, Luo retaliated against them with threats, harassment, firing, and even gang violence. On August 2, 2010, based on the drivers' evidence, the NYS Department of Labor determined that drivers of the Yes Car Service Enterprise are employees and not independent contractors, awarding unemployment insurance (UI) to one of the drivers and requiring that Luo hand in payroll records of all employees, which he had never submitted to the federal or state government. Luo appealed the decision and since then, federal government agents, including agents from the US Department of Labor have launched a campaign of harassment by repeatedly going to homes of drivers who testified during the UI hearings and threatening them with arrest and deportation if they didn't give false statements and recant their previous sworn testimonies. The drivers refused to lie under oath and continued to assert their rights under the law. On January 23, 2012, on the start of the Chinese New Year, three of the drivers Hong Xian Liu, Bi Sheng Liu, and Lin Guo were arrested. The US DOL is mandated to enforce the labor law. It should encourage workers to come forward. It should not abuse its public power by allowing its agents to attack workers who come forward to complain. It should not use workers' immigration status to discourage documented and undocumented workers from coming together to assert their rights. It should not aid lawbreaking employers to escape prosecution and promote sweatshops. Furthermore, the US Department of Labor under the Obama administration should not revive the Sensenbrenner Bill HR 4437 , by harassing, intimidating, and attacking organizations that assist undocumented workers who come together with documented workers to enforce the labor law. The US DOL not only deprived undocumented workers of their right to complain to government agencies, it also undermines the rights of citizens. We ask for your organization's support to demand the federal government: 1. Immediately release and dismiss the case of workers arrested. 2. Investigate and prosecute the federal government agents. 3. Ensure the rights of all workers to complain to federal and state government agencies regardless of their immigration status; equal rights for all workers. 4. Our Founders so deeply feared a tyranny of the majority that they rejected the idea of a direct vote for President. That's why they created the Electoral College. For more than two centuries it has encouraged coalition building, given a voice to both big and small states, and discouraged voter fraud. Unfortunately, there is now a well-financed, below-the-radar effort to do away with the Electoral College. It is called National Popular Vote or NPV, and it wants to do exactly what the Founders rejected: award the job of President to the person who gets the most votes nationally. Even if you agree with this goal, it's hard to agree with their method. Rather than amend the Constitution, which they have no chance of doing, NPV plans an end run around it. Here's what NPV does: it asks states to sign a contract to give their presidential electors to the winner of the national popular vote instead of the winner of the state's popular vote. What does that mean in practice? It means that if NPV had been in place in 2004, for example, when George W. Bush won the national vote, California's electoral votes would have gone to Bush, even though John Kerry won that state by 1.2 million votes! Can you imagine strongly Democratic California calmly awarding its electors to a Republican? Another problem with NPV's plan is that it robs states of their sovereignty. A key benefit of the Electoral College system is that it decentralizes control over the election. Currently, a presidential election is really 51 separate elections: one in each state and one in D.C. These 51 separate processes exist, side-by-side, in harmony. They do not -- and cannot -- interfere with each other. California's election code applies only to California and determines that state's electors. So a vote cast in Texas can never change the identity of a California elector. NPV would disrupt this careful balance. It would force all voters into one national election pool. Thus, a vote cast in Texas will always affect the outcome in California. And the existence of a different election code in Texas always has the potential to unfairly affect a voter in California. Why? Because state election codes can differ drastically. States have different rules about early voting, registering to vote, and qualifying for the ballot. They have different policies regarding felon voting. They have different triggers for recounts. Each and every one of these differences is an opportunity for someone, somewhere to file a lawsuit claiming unfair treatment. Why should a voter in New York get more or less time to early vote than a voter in Florida? Why should a hanging chad count in Florida, but not in Ohio? The list of possible complaints is endless.
