Why Filing a Complaint With NYS Dept. of Health Is Not the Same as Filing a Lawsuit in New York
http://www.Oginski-Law.com There are some who believe that if the New York State Department of Health determines that there was wrongdoing, that means they will get money for their injuries by the Dept. of Health. Filing a complaint with the New York State Department of Health is not the same thing as filing a lawsuit. Filing a complaint simply triggers an investigation by the Department of Health. The only way for you to obtain money for your injuries is to file a lawsuit. Once you have brought a lawsuit, the only way to get money for your injuries is If you are successful in your lawsuit. When the Department of Health does an investigation to determine whether treatment was appropriate, if they find that the treatment was not appropriate, they issue a statement of deficiencies. That itemizes and details exactly where the hospital staff went wrong. The hospital is then required to prepare a plan of correction in order to fix those deficiencies. When You Should File a Complaint with the Dep't of Health
The New York State Department of Health investigates complaints against doctors and hospitals. When you make a complaint, the Department of Health may investigate by reviewing the medical records and interviewing doctors and nurses. The investigation usually takes between 3-4 months. After the investigation has been completed, the Department of Health may issue a document called a "Statement of Deficiencies�?. The Statement of Deficiencies lists the specific deficiencies in medical treatment by the doctor or hospital and the hospital must respond with a document called a "Plan of Corrections�?. The Plan of Corrections shows the hospital's plan to avoid the same medical mistakes from happening again. How to Get the Statement of Deficiencies and Plan of Corrections You can get the Statement of Deficiencies and the Plan of Corrections by sending a request by mail to the Department of Health. While the names of the patient will be crossed out to preserve patient confidentiality, the Statement of Deficiencies and Plan of Corrections will give you great information about the specific findings of medical negligence. How Department of Health Findings Can Help Your Case The factual findings by the Department of Health are admissible in evidence at the trial of your medical malpractice lawsuit. Let's say, for example, that the Statement of Deficiencies states that " Doctor Smith altered the medical records six months after the treatment was provided. �? This is a specific factual finding that your lawyer can introduce into evidence at the trial. With this factual finding from the Department of Health, you have a government agency substantiating your argument that the medical records were altered to cover-up the medical mistake. When a government agency like the Department of Health substantiates your claim, you have independent proof that your claim is true. Findings of fact by the Department of Health are powerful evidence.

After my mother’s first total knee replacement surgery she needed to be transferred to a skilled nursing facility for rehabilitation and physical therapy. The social worker needed the names of 5 facilities we would like to go to in order of desire. There are many skilled nursing facilities near us, however, the selection process was not easy. Discriminated Against by NY Workers Compensation IME Doctor SCAM

While suffering from a DVT (deep venous thrombosis) blood clot derived from an accident while working as a crane operator in Times Square on August 4th 2006, I was forced to track back & forth to doctors, Court & exams for a full TWO (2) YEARS while the blood clot slowly crawled up my leg, to my gut on its way up to my heart & lungs where it would eventually kill me. I told the truth about the IME (independent medical examiner) insurance doctor who filed those fraudulent reports about examining me, when in fact I was only there 3 minutes & got into a confrontation with him for battering my right broken wrist that I just got a cast off & causing a tear in it. He then filed a fraudulent report that he examined all these parts of my body, legs, arms, wrists etc..I was only there 3 whole minutes & my medical records prove from day 1 that anything he testified to or reported was LIES & FRAUD. The judge became angry because I started writing letters to politicians & the NY State Insurance Fund & filing complaints to blow the whistle. He continued to try to intimidate me, yelled at me, slammed his fists & palms down on the bench throughout the entire trial in order to silence me. I protested the case right on record & he continued to push the case along & refused to allow me to speak or submit evidence. My lawyer quit the case because I asked him to testify to the truth about what happened with the angry judge. In this film clip, nurse Rosemary Cook describes her experience with unsafe conditions while working at a nursing home in Oklahoma in 1994 and being fired after filing complaints with OSHA and the state health department. In 1997, a U.S. District Court ruled there was retaliation in violation of the U.S. Occupational Safety and Health Act, which staes that it is illegal for an employer to fire, demote, transfer or otherwise retaliate against a worker for using their rights under the law. This clip is from OSHA’s 1999 Worker Memorial Day press event on April 28 when Ms. Cooke received an award from Labor Secretary Alexis M. Herman for her courage as a whistleblower. In June 1994, she was hired as a charge nurse at Skyline Terrace Nursing Home in June 1994, her first position after completing her nursing education in May 1994. She soon learned of Skyline Terrace's policy that gloves were only to be worn when the nurse saw visible blood. Ms. Cook asked to wear gloves whenever she might come in contact with bodily fluids, and her employer granted her permission. OSHA’s Bloodborne Pathogen standard requires wearing of gloves in healthcare settings and had been in effect for about two years. Soon after, she arrived at work and found no protective gloves for the staff. She found gloves for staff and herself, ultimately using the special facility supply of expensive sterile gloves. Ms. Cook submitted a "report to administration" form relating the lack of gloves and the next morning, reported the incident to "[e]verybody I ran into." On another day soon afterwards, no regular use latex gloves were present in the facility and again she submitted a written report to the administrative office and an oral report to the nurses. The next day, she again found no regular use latex gloves. A note had been placed on the nurses' station stating that medical supplies should only be ordered once a week. Further, that "an extremely large quantity of gloves is being requested. Please use your gloves as directed, only. Ms. Cook used her own gloves which she had purchased and again sterile gloves were used. She continued to be concerned about the glove supply at Skyline Terrace and filed complaints with OSHA and the Oklahoma State Department of Health and OSHA. After an inspector visited the facility to investigate her complaint, Ms. Cook was fired for alleged deficiencies in patient care and supervision of the aides under her direction. The Federal District Court discounted this as a transparent attempt to create some justification for firing the nurse. In general, if an employee files a complaint over an occupational safety and health issue, then is treated adversely by the employer and it appears there is some cause-and-effect connection, and then sues, the employer has to come to court with evidence it was not trying to retaliate. When HIP/GHI sought approval for the change to for profit status, they promised to the people of NY and especially their members that: Conversion to for-profit status will not affect service to our members, their access to doctors, their benefits, or the levels of service that they currently receive. Over time, as new products and services are introduced, members should see greater flexibility in types of coverage, more choice in benefit plans, and more customer-driven innovations that improve access to care. It is obvious that this promise has been broken because with such low reimbursement rates the level of service to the members will definitely be affected. Many physical therapists in New York are already dropping out HIPs panel, while others have filed complaints with the Attorney Generals Office and the State Insurance Commissioner.

Ok so I was looking at this graph put on Uber’s website today and thought it looked too good to be true. How amazing that Uber drivers make more than any other type of driver. But I knew from my own experience as a rider that Uber didn’t cost that much. In fact, Uber is pretty cheap if you’re a passenger. Sooooo…. how can uber be so cheap, and yet the drivers make so much money??? Now Uber has cut pay to drivers in Detroit to 24cents a mile , but we’re going to stick to the 90c for now. Uber takes 20% of the total fare from the driver for older drivers. Newer drivers get 25% taken. So we’re down to 67.5c per mile. Then you have to deduct tax: In some LA County's, sales tax is as high as 10%, and Uber doesn’t withold taxes for you. The drives are responsible for keeping this money aside to pay the tax department in April. So with the 10% deducted, we’re down to (just over 60 cents) 60.75c Now we need to factor in depreciation of the car. A car is an asset like anything else, and will eventually wear out and you’ll have to buy a new one. Every mile you drive decreases the value of your car and brings you that much closer to needing a new one. This is a big problem if you drive for a living, you’re going to need to buy a new car every two or three years and the cost of a new car is significant. The IRS estimates vehicle cost to drive a vehicle for work at $0.54 a mile . Broken down into Fuel costs @ an average of 12c per mile Depreciation at $0.24c per mile. Repairs, tyres, & maintainence at 9c per mile Insurance, licence, registration, finance, fees - average out to around 9c per mile So with 54c depreciation, repairs, and fuel accounted for, we’re down to just over 6c per mile that actually goes into your hands of drivers. Given that Uber also asks its drivers to buy things like bottles of water, gum, and chargers for it’s passengers, we can say for certain that driving for Uber pays well below minimum wage or even worse, costing drivers money (as is seen directly in this actual fare uber charged one of it’s drivers). So given the math is so bad, why does anyone drive for Uber? Here’s an example of a post an Uber driver posted - he was $400 behind on the rent, and needed to make up some quick cash. In a way, uber is kind of like a loans scheme. Now for some people in desperate circumstances, what Uber’s offering might be an acceptable deal. But for most people, driving for Uber is a waste of time. I wish Uber would be more honest with people. By our calculations, the amount you’re making as an uber driver is nowhere near $19 per hour. If you drive 30 miles per hour at 6.75c per hour, you’re only making $2.00 per mile - by far the worst choice of any transportation job. This number is supported by Not Cool Uber, who have tracked hourly earnings to be around $2.89 and, after vehicle fees are taken into account, $0. Now – I’m not against car pooling. We all need transport, and I know I am a frequent user of Uber & Lyft. But I think that Uber is going about it in an unethical way, which makes me unethical for supporting them as a customer. Uber could easily fix this situation : by reducing their commission, by making rates more reasonable, by giving riders the option to Tip their drivers, or just by being transparent. But that would mean admitting that they’ve generated significant revenue from effectively exploiting their drivers. So the truth is, Uber benefits from maintaining this status quo. Uber is currently reported to be making $10 billion in revenue per year - and that money has to come from someone. Just don’t let that someone be you. "Painless" Parker flourished. Despite dentistry becoming regulated, unlicensed dentists still practiced, often offering inferior services, prompting some to call for their prosecution. As many as 5000 unlicensed dentists may have practiced in New York in the early 1900s. In 1900, 283 complaints were received by the Law Committee of the New York State Dental Society. Some patients died from infections and abscesses resulting from lack of sanitation. Others died from improper administration of anaesthetic. According to a newspaper report in 1910, many of these dentists were immigrants whose home countries did not regulate dentistry as stringently as did the United States. In India, street services are plentiful, with dentists operating alongside other street services, such as apothecaries, repairmen, and barbers. These practitioners charge far less than licensed dentists, often charging as little as 125 rupees for a procedure such as a bridge—which, at a licensed dentist, could be as expensive as 10,000 rupees. Many learn the trade from their parents. Street dentistry is not confined to India. In Paris in 2003, 23 unlicensed dentists who practiced out of cafes and grocery stores were arrested. The dentists involved were Syrian immigrants who provided dental services mostly for other immigrants who did not have health insurance. In 1998, a man was arrested in Van Nuys, California for operating an unlicensed dental practice out of the back of a toy store in a strip mall. In India, Chapter V, Section 49 of the Dentist Act of 1948 requires dentists, dental mechanics, and dental hygienists to be licensed, making street dentistry illegal, though street dentists continue to practice. Most countries in the developed world have laws preventing the unlicensed practice of dentistry.

Their plan to seal the remaining house with toxic spray sealant over the stench of the remaining structure was in our minds, pathetic and devious. The majority of the interior was finished in rough wood which would have required the application of an immense amount of spray in the attempt to seal in the stink. I wrote the song to alert people how Allstate deals with a major home loss. We had enough savings to take care of expenses after the 10 months of negotiating including the rental house, utilities and the fees for storage of our salvageable goods. We are concerned that many homeowners may not be able to do this because of these necessary out of pocket expenses. I hope that this video stimulates people to invest time into reading their policies and choosing a company that will take care of them if something like this happens in their lives. Campaign has been organizing thousands of workers throughout New York State to stand up against sweatshop conditions in the service industry. In spite of firing, blacklisting and even physical assault from employers, many workers have still come forward to fight for their rights. This has not only improved working conditions, but also has helped many other workers gain confidence to enforce the law through litigation or filing complaints with government agencies. In 2009, due to the complaints of 20 drivers of the Flushing New York enterprise, Yes! Car Service, the NY State Department of Labor began investigating rampant misclassification practices in the car service industry. For over ten years, drivers worked up to 16 hours per day without any wages and were forced to pay the company weekly fees to work. Owner Tony Luo collected all cash from the drivers and did not report to the government. When drivers protested the fees, Luo retaliated against them with threats, harassment, firing, and even gang violence. On August 2, 2010, based on the drivers' evidence, the NYS Department of Labor determined that drivers of the Yes Car Service Enterprise are employees and not independent contractors, awarding unemployment insurance (UI) to one of the drivers and requiring that Luo hand in payroll records of all employees, which he had never submitted to the federal or state government. Luo appealed the decision and since then, federal government agents, including agents from the US Department of Labor have launched a campaign of harassment by repeatedly going to homes of drivers who testified during the UI hearings and threatening them with arrest and deportation if they didn't give false statements and recant their previous sworn testimonies. The drivers refused to lie under oath and continued to assert their rights under the law. On January 23, 2012, on the start of the Chinese New Year, three of the drivers Hong Xian Liu, Bi Sheng Liu, and Lin Guo were arrested. The US DOL is mandated to enforce the labor law. It should encourage workers to come forward. It should not abuse its public power by allowing its agents to attack workers who come forward to complain. It should not use workers' immigration status to discourage documented and undocumented workers from coming together to assert their rights. It should not aid lawbreaking employers to escape prosecution and promote sweatshops. Furthermore, the US Department of Labor under the Obama administration should not revive the Sensenbrenner Bill HR 4437 , by harassing, intimidating, and attacking organizations that assist undocumented workers who come together with documented workers to enforce the labor law. The US DOL not only deprived undocumented workers of their right to complain to government agencies, it also undermines the rights of citizens. We ask for your organization's support to demand the federal government: 1. Immediately release and dismiss the case of workers arrested. 2. Investigate and prosecute the federal government agents. 3. Ensure the rights of all workers to complain to federal and state government agencies regardless of their immigration status; equal rights for all workers. 4. Do not revive HR 4437. - Justice Will Be Served! Campaign

It's something he remembered a years ago. It's something he knew. In fact, two years earlier when he was asked the same question by the defense attorney during pretrial questioning, he knew this answer exactly. Can I use his pretrial testimony to refresh his memory about a specific event that he is currently having difficulty remembering? The answer is yes, I can. How do we actually do this? Let me give you an example... Let's say it is a medical practice trial and my client is on the witness stand explaining what the doctor did during each of his visits. I now ask him to explain when his next visit to the doctor was. He's having difficulty remembering whether it was in December, January or February. In fact, he's having difficulty remembering exactly what he said to the doctor on that particular visit. He's struggling. He sincerely doesn't remember. Even though he reviewed his pretrial testimony in anticipation of coming in to testify today, he simply does not remember. Even though a witness or a litigant has given pretrial testimony, the transcript of that question and answer session is simply not admitted into evidence. The jury does not know what questions and what answers were given two years earlier when the defense attorney was in our office questioning my client about what happened. I can always pull out a copy of the medical records which will have been admitted into evidence to tell my witness what is recorded in the medical record. However, in many cases I would prefer to have my client explain, in his own words, exactly what happened and when. That does not mean that he needs to memorize exact dates and times in order to be successful. This is not a memory test. Instead, if the witness is unable to remember events that occurred years ago, I can now use different documents and even pretrial testimony to try and refresh his memory. So here is how we do it... “Mr. Jones, two years ago you were in my office with the defense attorney asking you questions and you giving answers, correct?” “Yes, I remember that. You called that a deposition.” “That's correct. Now, I'm going to read to you from the transcript of the questions that you were asked and some of the answers that you gave. Let's look at page 17, line 9... Question: When did you next see Dr. Gonzalez? Answer: I saw him December 15. Question: what complaints did you make to Dr. Gonzalez at that time? Answer: I told him I was having difficulty breathing. I told him I had difficulty going up the stairs. I told him I was coughing up blood. Mr. Jones, were you asked those questions and did you give those answers at that time?” “Yes I did.” “When you gave those answers to those questions, were they accurate at that time?” “Yes they were.” “Did those questions and those answers refresh your memory about when you last saw Dr. Jones in his office?” “Yes they do. I now remember that I did see him on December 15.” “Did those questions and those answers refresh your memory about what specific complaints you made him on that last visit?” “Yes they do.
