This in on 8-2: - DEPARTMENT STRESSES STATE REGULATORY re ASSOCIATION HEALTH PLANS - On August 2, PA Insurance Commissioner Altman sent letters to HHS Secretary Azar and U.S. Department of Labor Secretary Acosta addressing concerns PA has about President Trump’s rule on Association Health plans (AHPs) which takes effect September 1, 2018.   The core concern is that an association may provide for health insurance for its members ONLY if it meets PA legal requirements of organizing for purposes other than insurance and has been in existence for at least two years.  In addition, AHPs must be fully insured using an insurance entity which has a certificate of authority to do business in the Commonwealth.  Her letter also made the following points: - A sole proprietor is part of the individual insurance market and is not an employer for purposes of health insurance coverage. - An AHP is actually a Multiple Employer Welfare Arrangement (MEWA). - Policy forms, rates, solvency and insurance broker licensing requirements for both in-state and out of state insurance producers are regulated by state law. - Short-Term Medical (STM) in 60 days will become Short-Term Limited Duration Insurance (STLDI). No longer an 89 day maximum limit per policy. Now policies can be written for a period not to exceed 364 days. 2019….STLDI will be a big player IF Pennsylvania doesn’t put up any roadblocks. Agents and Carriers must advertise a comprehensive disclaimer making sure these plans are NOT sold as ACA and that the consumer understands the program fully. MD, VT, HA, VA all passed state legislation limiting sales to less than three months. - 2019 FFM Certification: AHIP and MLMS. AHIP and MLMS are both available. (Remember HBS requires FFM certification and Ethics Certification for OFF-Market sales, too.) - Reminder: Employer affordability is going from 9.56% in 2018 to 9.86% in 2019. - Public Comment on future Risk Adjustment payments for 2018 and 2019 coverage years. 2017 has been restored. - CBC: Effective for 10-1-18 effective dates, ALL small Group ASO and Mid-Market New Business will be subject to medical underwriting regardless of census size. It covers primarily HIPAA Privacy and also an overview of the HIPAA regulations in general including Security and Transactions.
